New Mexico Law Fourth Degree Felony?

okay im being falsly accused of a crime i didnt commit and its a fourth degree felony for automobile burglary and theft of a credit card.im a teenager so i was wondering what i could be facing like probation or fines or something

It sounds like you were actually charged with two seperate fourth degree felonies. Vehicle Burglary and Theft of a Credit Card are each a fourth degree felony.

If convicted, you will be facing a maximum sentence of 18 months and $5000.00 for each offense. So together, that could mean 36 months and $10000.00. Realistically, even if convicted for both, they would almost certainly run them together, and for a period less than the maximum. You say you’re a teenage, but not how old. If you are 18 or 19, you’re an adult and it’s not gonna be easy. If you’re 17 or under, then as a juvenile, you would possibly receive a few months confinement and several months probation. A lot would depend on if you have a record or not. If you have a record, they may ask for the whole 18 months.

Since these are felonies, you need to consult your attorney. If you are truly innocent, fight it. If you did it, it’s time to accept responsibility for your actions. Either way, make sure that you tell your attorney everything you know about what happened and why the police (or this person accusing you) say that you did it. If your attorney doesn’t know the whole story, they won’t be able to help you. That’s their job, help them to do it.

I was just outlining the possible scenarios based on the particular laws of your state. The actual sentence will determined by the judge, with a recommendation (which he may or may not follow) from the district attorney. There are a lot of factors that they will take into account when determining what sentence you will receive.

Again, the best thing to do is to speak with your defense attorney, because he will be able to work with the district attorney on things and can even make a request to the judge for a particular sentence. Your attorney is there to help you, so talk to him about your concerns. Also, talk to your parents about everything and have them talk to your attorney if he is not listening to you.
