Mark, a minor, operates a one-man automobile repair shop. Rose, having heard of mark’s good work on other cars, takes her car to Mark’s, while overhauling Rose’s engine, carelessly fits an unsuitable piston ring on one of the pistons, with result that Rose’s engine is seriously damaged. Mark offers to return the sum that Rose paid him for his work, but refuses to make good on damage to her engine. Can Rose recover from Mark in tort for the damage to her engine? why? Explain

The general theory of torts of negligence is Duty-Breach-Causation-Damage.

Mark’s duty was to conduct the repair competently.

The question here is whether that was done, or if he breached that duty. If “unsuitable” basically means “wrong” as in for another type of car entirely, then that would be a breach. He might avoid it if it were a fault of the part supply house, mislabeling the item, but that’s probably not the case.

That breach caused the damage.
